Council Regulation (EC) No 377/2004 lays down the obligation to establish forms of cooperation among immigration liaison officers of Member States, the objectives of such cooperation, the functions and appropriate qualifications of such liaison officers, as well as their responsibilities vis-à-vis the host country and the posting Member State.

Moving on to the substance of this issue, the immigration liaison officers’ network was created by Council Regulation (EC) No 377/2004. This instrument states that the liaison officers will be representatives of a Member State posted abroad by the immigration service or other appropriate authority with the aim of establishing and maintaining contact with the authorities of the host country, aiming to contribute to the prevention and combat of clandestine immigration, the repatriation of irregular immigrants and the management of legal immigration.

In accordance with Article 6 paragraph 1 of Council Regulation (EC) No 377/2004 of 19 February 2004 on the creation of an immigration liaison officers network (hereinafter: Regulation) ‘The Member State holding the Presidency of the Council of the European Union or, if this Member State is not represented in the country or region, the Member State serving as acting Presidency shall draw up by the end of each semester a report on the activities of immigration liaison officers networks in which it has a representative, as well as on the situation in the host country, in matters relating to illegal immigration to the Council and the Commission’.
Conformément à l’article 6, paragraphe 1, du règlement (CE) no 377/2004 du Conseil du 19 février 2004 relatif à la création d'un réseau d'officiers de liaison «immigration» (ci-après: le règlement), «l'État membre qui exerce la présidence du Conseil de l'Union européenne ou, si cet État membre n'est pas représenté dans le pays ou la région, l'État membre exerçant la présidence par intérim, établit pour la fin de chaque semestre, à l'intention du Conseil et de la Commission, un rapport sur les activités des réseaux d'officiers de liaison «immigration» dans lesquels il a un représentant, ainsi que sur la situation dans le pays hôte en matière d'immigration illégale».

(5) Following the Thessaloniki European Council, it is necessary to formalise the existence and functioning of such a network - drawing on experiences gained in the operation of running projects, including the Belgian-led Western Balkans ILO network - through a legally binding act, setting out the obligation to establish forms of cooperation among immigration liaison officers of the Member States, the objectives of such cooperation, the functions and appropriate qualifications of such liaison officers, as well as their responsibilities vis-à-vis the host country and the sending Member State.
(5) À la suite du Conseil européen de Thessalonique, il est nécessaire de formaliser l'existence et le fonctionnement de ce réseau - sur la base de l'expérience acquise en matière de gestion de projets, tels que le réseau OLI des Balkans occidentaux dirigé par la Belgique - au moyen d'un acte juridiquement contraignant qui prévoie l'obligation d'établir des formes de coopération entre les officiers de liaison "Immigration" des États membres, les objectifs de cette coopération, les fonctions de ces officiers de liaison et les qualifications qu'ils devront posséder, ainsi que leurs devoirs et obligations vis-à-vis du pays hôte et de l'État membre d'origine.

(3) At its meeting of 28 and 29 November 2002 the Council adopted conclusions on the improvement of the Immigration Liaison Officers Network, taking note of the report of the Presidency, showing that a network of liaison officers is in place in most of the countries surveyed in the report, but noting also that there was a need to further strengthen this network.
(3) Lors de sa session des 28 et 29 novembre 2002, le Conseil a adopté des conclusions sur l'amélioration du réseau d'officiers de liaison "Immigration" en prenant acte du rapport de la présidence, qui indique qu'un réseau d'officiers de liaison est en place dans la plupart des pays considérés, mais en notant par ailleurs qu'il était nécessaire de renforcer encore ce réseau.

In any event, as the Council itself recently acknowledged, a clearer distinction should be made between the roles of liaison officers, ‘Immigration’ liaison officers, airport liaison officers, documentary advisers, technical advisers and consular services, all of which deal with immigration issues.

1a. The Member States shall notify the General Secretariat of the Council of their annual planning in respect of their liaison officers and – other than in exceptional and duly justified cases – of their intention to dispatch a liaison officer to a third country or to an international organisation. Notification shall be sent two months prior to the planned date of dispatch.
1 bis. Les États membres informent le Secrétariat général du Conseil au sujet de la programmation annuelle de leurs officiers de liaison et, sauf cas exceptionnels dûment justifiés, de leur intention d'envoyer un officier de liaison dans un pays tiers ou dans une organisation internationale, deux mois avant la date de détachement prévue.

Member States shall inform the General Secretariat of the Council of the European Union (hereinafter "the General Secretariat of the Council") each year of posting of liaison officers, the tasks and the powers assigned to those officers and any cooperative agreements between the Member States on the posting of liaison officers.
