In order to strengthen trade mark protection and combat counterfeiting more effectively, and in line with international obligations of the Union under the framework of the World Trade Organisation (WTO), in particular Article V of the General Agreement on Tariffs and Trade (GATT) on freedom of transit and, as regards generic medicines, the ‘Declaration on the TRIPS Agreement and public health’ adopted by the Doha WTO Ministerial Conference on 14 November 2001, the proprietor of an EU trade mark should be entitled to prevent third parties from bringing goods, in the course of trade, into the Union without being released for free circulation there, where such goods come from third countries and bear without authorisation a trade mark which is identical or essentially identical with the EU trade mark registered in respect of such goods.
Afin de renforcer la protection conférée par la marque et de lutter plus efficacement contre la contrefaçon, et conformément aux obligations internationales auxquelles est soumise l'Union dans le cadre de l'Organisation mondiale du commerce (OMC), en particulier l'article V de l'accord général sur les tarifs douaniers et le commerce (GATT) relatif à la liberté de transit et, pour ce qui est des médicaments génériques, la «Déclaration sur l'accord sur les ADPIC et la santé publique» adoptée lors de la conférence ministérielle de l'OMC à Doha, le 14 novembre 2001, il convient de permettre au titulaire d'une marque de l'Union européenne d'empêcher des tiers d'introduire dans l'Union, dans la vie des affaires, des produits sans qu'ils y soient mis en libre pratique, lorsque ces produits viennent d'un pays tiers et portent sans autorisation une marque identique ou pour l'essentiel identique à la marque de l'Union européenne enregistrée pour ces produits.

The applicant for an international registration designating the Union may claim, in the international application, the seniority of an earlier trade mark registered in a Member State, including a trade mark registered in the Benelux countries, or registered under international arrangements having effect in a Member State, as provided for in Article 39.

When adopting delegated acts and implementing acts, the Commission shall consider international obligations of the Union and the applicable Union social, environmental and animal welfare standards, the need to monitor evolution of trade and market developments, the need for sound market management and the need to reduce the administrative burden.

(3) The completion of the internal market and of economic and monetary union, the enlargement of the European Union and the lowering of international barriers to trade and investment will continue to result in major corporate reorganisations, particularly in the form of concentrations.
