IN-CONTEXT TRANSLATIONS

Unless otherwise specified in this title, this Regulation and the delegated acts adopted pursuant to this Regulation shall apply to applications for international registrations under the Protocol relating to the Madrid Agreement concerning the international registration of marks, adopted at Madrid on 27 June 1989 (hereafter referred to as ‘international applications’ and ’the Madrid Protocol’ respectively), based on an application for a European Union trade mark or on a European Union trade mark and to registrations of marks in the international register maintained by the International Bureau of the World Intellectual Property Organisation (hereafter referred to as ‘international registrations’ and ’the International Bureau’, respectively) designating the European Union '.

18. Urges the EU to pro-actively contribute and support, at the upcoming HRC session, a resolution relating to the report on follow-up of the committee of independent experts to the international Fact-Finding mission on the Gaza conflict in order to ensure accountability for the violations of international law and support a referral to the GA and to International Justice mechanisms in case of Israel and Palestinian parties have failed to comply with their obligation to carry out investigations according to international standards; further calls on the High Representative to actively monitor compliance with the findings of the ‘Follow-up to the report of the international fact-finding mission on the incident of the humanitarian flotilla’, ensuring principles of accountability and liability are upheld; welcomes the statements by the UN High Commissioner for Human Right on her first visit to the occupied Palestinian territory and Israel and, in particular, the strong message that she conveyed that ‘international human rights law and international humanitarian law are not negotiable’;
18. presse l'Union de prendre des initiatives, lors de la prochaine session du CDH, afin d'apporter sa contribution à une résolution relative au rapport sur la suite donnée par le comité d'experts indépendants à la mission d'enquête sur le conflit à Gaza et de la soutenir afin de veiller à ce que les coupables de violations du droit international rendent compte de leurs agissements et d'appuyer une saisine de l'Assemblée générale des Nations unies et le recours aux mécanismes de justice internationale dans l'éventualité où les parties israélienne et palestinienne ne se seraient pas conformées à leur obligation de mener des enquêtes, conformément aux normes internationales; invite en outre la haute représentante à contrôler activement le respect des constatations de la "suite donnée au rapport de la mission internationale d'établissement des faits concernant l'incident de la flottille humanitaire", en garantissant le respect de l'obligation de rendre des comptes et du principe de responsabilité; salue les déclarations de la Haute commissaire des Nations unies aux droits de l'homme à l'occasion de sa première visite dans les territoires palestiniens occupés et en Israël et notamment le message fort qu'elle a fait passer, à savoir que le droit international en matière de droits de l'homme et le droit humanitaire international ne sont pas négociables;

This is also how Community law is supposed to have arisen and, according to the traditional approach to international law, how its validity is supposed to take precedence over national law, either by virtue of transposition by a national implementing law (in the system known as 'dualism') or, ipso iure, as higher-ranking international law (what is known as 'monism').This report starts from the assumption of qualified monism. According to the prevailing doctrine of the primacy of the international legal order, one of the norms obtained by custom and conviction constitutes the basis for the validity of the legal orders of individual States. The latter are subordinate to international law by virtue of the context in which they come into being. Another one of the principles obtained from the basic norm 'custom and conviction create international law' is that international treaties (in other words, non-customary sources of law) must be complied with ('pacta sunt servanda'). Under another principle of international law, the law of States, which are conceived as the primary subjects of international law, is left essentially untouched by international law and that each of those States is itself competent to regulate the validity and scope of international law within its domestic sphere of influence and that States are entitled to develop their domestic sphere of influence inwards.
