Intended, in instances where the Treaty does not provide an explicit legal basis, to enable the Council to ‘take the appropriate decisions’ to ‘attain . one of the objectives of the Community’, Article 308 represents, in terms of the hierarchy of acts, a dual anomaly: a hybrid article, half constitutional and half legislative, it amalgamates in a single act the legal basis and the corresponding legislative provisions. Given that the acts for which it makes provision are subject to particularly strict procedural rules – adoption by a unanimous decision and imposition on Parliament of the ignominious consultation procedure – the eminent position in the hierarchy which it confers on the acts for which it makes provision seems to be matched by the dubious privilege of seeing such acts exempted from the democratic procedures customarily employed for the adoption of legislative acts.
