The Commission came to the conclusion that apparently the State guarantees fall within the scope of Article 87(1) EC Treaty but were partly in line with Article 87(3) c EC Treaty and the Communities rescue and restructuring guidelines: While considering that the initial State guaranteed loan of EUR 50 million was indeed necessary to keep MobilCom afloat for the transitory period, the Commission had doubts whether the second State guaranteed loan could qualify as rescue aid.
