Other international legal instruments deal with children in conflict situation, in particular the Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflicts[2], the Geneva Convention IV of 1949 relative to the Protection of Civilian Persons in time of war[3], the Protocols I + II Additional to the Geneva Convention of 1949 and relating to the Protection of Victims of Armed Conflicts[4], all of which recognise specific needs of protection for children, together with the Statute of the International Criminal Court which defines as a war crime the enrolment of children under the age of 15 in national armed forces or the use of them as active participants in hostilities[5].

(a) “First Convention” , “Second Convention” , “Third Convention” and “Fourth Convention” mean, respectively, the Geneva Convention for the Amelioration of the Condition of the Wounded and Sick in Armed Forces in the Field of 12 August 1949; the Geneva Convention for the Amelioration of the Condition of Wounded, Sick and Shipwrecked Members of Armed Forces at Sea of 12 August 1949; the Geneva Convention relative to the Treatment of Prisoners of War of 12 August 1949; the Geneva Convention relative to the Protection of Civilian Persons in Time of War of 12 August 1949; “the Conventions” means the four Geneva Conventions of 12 August 1949 for the protection of war victims;
a) les expressions « I Convention » , « II Convention » , « III Convention » et « IV Convention » s’entendent, respectivement, de la Convention de Genève pour l’amélioration du sort des blessés et des malades dans les forces armées en campagne, du 12 août 1949; de la Convention de Genève pour l’amélioration du sort des blessés, des malades et des naufragés des forces armées sur mer, du 12 août 1949; de la Convention de Genève relative au traitement des prisonniers de guerre, du 12 août 1949; de la Convention de Genève relative à la protection des personnes civiles en temps de guerre, du 12 août 1949; l’expression « les Conventions » s’entend des quatre Conventions de Genève du 12 août 1949 pour la protection des victimes de la guerre;

Persons protected by the Geneva Convention for the Amelioration of the Condition of the Wounded and Sick in Armed Forces in the Field of August 12, 1949, or by the Geneva Convention for the Amelioration of the Condition of Wounded, Sick and Shipwrecked Members of Armed Forces at Sea of August 12, 1949, or by the Geneva Convention relative to the Treatment of Prisoners of War of August 12, 1949, shall not be considered as protected persons within the meaning of the present Convention.

The present Convention, which bears the date of this day, is open to signature until February 12, 1950, in the name of the Powers represented at the Conference which opened at Geneva on April 21, 1949; furthermore, by Powers not represented at that Conference, but which are parties to the Xth Hague Convention of October 18, 1907, for the adaptation to Maritime Warfare of the principles of the Geneva Convention of 1906, or to the Geneva Conventions of 1864, 1906 or 1929 for the Relief of the Wounded and Sick in Armies in the Field.
