IN-CONTEXT TRANSLATIONS

(19) In order to ensure the appropriate level and distribution of renewal fees in compliance with the principles set out in this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of the level of the renewal fees for European patents with unitary effect and the distribution of such fees between the European Patent Organisation and the participating Member States.

(17) In order to determine the appropriate level and distribution of renewal fees and to ensure that all costs of the tasks in relation to the unitary patent protection entrusted on the European Patent Office are fully covered by the resources generated by the European patents with unitary effect and that, together with the fees to be paid to the European Patent Organisation during the pre-grant stage, the revenues from the renewal fees ensure a balanced budget of the European Patent Organisation.
(17) Afin de déterminer quels seraient le niveau et la répartition appropriés des taxes annuelles et de s'assurer que tous les coûts des tâches à exécuter dans le domaine de la protection par brevet unitaire confiées à l'Office européen des brevets sont intégralement couverts par les ressources provenant des brevets européens à effet unitaire, les recettes tirées des taxes annuelles, en combinaison avec les taxes à payer à l'Organisation européenne des brevets avant la délivrance, devraient garantir l'équilibre budgétaire de l'Organisation.

In the distribution of renewal fees among Member States it might be more practical to ensure a distribution based on the size of the market (not in terms of population but in terms of market covered by the patent) but at the same time ensuring nonetheless some form of minimum payment to all participating MSs.
