If the seller has delivered goods before the date for delivery, he may, up to that date, deliver any missing part or make up any deficiency in the quantity of the goods delivered, or deliver goods in replacement of any non-conforming goods delivered or remedy any lack of conformity in the goods delivered, provided that the exercise of this right does not cause the buyer unreasonable inconvenience or unreasonable expense.

The Court finds, however, that in the situation in which replacement of the defective goods, as the only possible remedy, involves disproportionate costs because of the need to remove the goods not in conformity from where they have been installed and to install the replacement goods, the directive does not preclude the consumer’s right to reimbursement of the cost of removing the defective goods and installing the replacement goods from being limited, where necessary, to an amount proportionate to the value the goods would have if there were no lack of conformity and the significance of the lack of conformity.

The Court also holds that the directive precludes national legislation under which the seller is entitled to refuse to replace goods not in conformity, where that is the only possible remedy, on the ground that replacement would impose costs on him that are disproportionate with regard to the value the goods would have if there were no lack of conformity and the significance of the lack of conformity.
La Cour juge, par ailleurs, que la directive s’oppose à ce qu’une législation nationale accorde au vendeur le droit de refuser le remplacement d’un bien non conforme, en tant que seul mode de dédommagement possible, au motif que celui-ci lui impose des coûts disproportionnés au regard de l’importance du défaut de conformité et de la valeur qu’aurait le bien s’il était conforme.

Even assuming that the lack of conformity of the goods does not result from fault on the part of the seller, the fact remains that by delivering goods not in conformity he fails correctly to perform the obligation which he accepted under the contract of sale, and he must therefore bear the consequences of that defective performance.
En effet, même dans l’hypothèse où la non-conformité du bien ne résulte pas d’une faute du vendeur, il n’en reste pas moins que, en livrant un bien non conforme, celui-ci n’a pas correctement exécuté l’obligation à laquelle il s’était engagé en vertu du contrat de vente et il doit donc assumer les conséquences de sa mauvaise exécution.

5. Any lack of conformity resulting from the incorrect installation of the goods shall be considered as a lack of conformity of the goods where the installation forms part of the sales contract and the goods were installed by the trader or under his responsibility.
