12. In the event that one or several regulatory authorities request an amendment to approve the terms and conditions or methodologies submitted in accordance with paragraphs 6, 7 and 8, the relevant TSOs or NEMOs shall submit a proposal for amended terms and conditions or methodologies for approval within two months following the requirement from the regulatory authorities.

4. In Member States where, in accordance with national law and/or practice, the setting of the terms and conditions of employment of posted workers referred to in Article 3 of Directive 96/71/EC, and in particular the minimum rates of pay, including working time, is left to management and labour they may, at the appropriate level and subject to the conditions laid down by the Member States, also monitor the application of the relevant terms and conditions of employment of posted workers, provided that an adequate level of protection equivalent to that resulting from Directive 96/71/EC and this Directive is guaranteed.
4. Dans les États membres où, conformément au droit et/ou aux pratiques nationales, la définition des conditions de travail et d'emploi des travailleurs détachés visées à l'article 3 de la directive 96/71/CE, notamment le taux de salaire minimal et le temps de travail, relève de la responsabilité des partenaires sociaux, ceux-ci peuvent également contrôler, au niveau approprié et suivant les conditions établies par les États membres, l'application des conditions de travail et d'emploi des travailleurs détachés pertinentes, sous réserve qu'un niveau de protection adéquat, équivalent à celui résultant de la directive 96/71/CE et de la présente directive, soit garanti.

5. Member States where labour inspectorates have no competence with respect to the control and monitoring of the working conditions and/or terms and conditions of employment of posted workers may, in accordance with national law and/or practice, establish, modify or maintain arrangements, procedures and mechanisms guaranteeing the respect of these terms and conditions of employment, provided that the arrangements offer the persons concerned an adequate degree of protection equivalent to that resulting from Directive 96/71/EC and this Directive.
5. Les États membres dans lesquels les services d'inspection du travail ne sont pas compétents en matière de contrôle et de surveillance des conditions de travail et/ou des conditions d'emploi des travailleurs détachés peuvent, conformément au droit et/ou aux pratiques nationales, établir, modifier ou maintenir des dispositions, des procédures et des mécanismes garantissant le respect de ces conditions, pour autant que ceux-ci offrent aux personnes concernées un niveau de protection adéquat, équivalent à celui résultant de la directive 96/71/CE et de la présente directive.

In particular, this Directive should not affect the terms and conditions of employment which, pursuant to Directive 96/71/EC of the European Parliament and of the Council , apply to workers posted by an undertaking established in a Member State to provide a service in the territory of another Member State.

These are: maximum work periods and minimum rest periods, minimum paid annual holidays, minimum rates of pay, including overtime rates, the conditions of hiring out of workers, in particular the protection of workers hired out by temporary employment undertakings, health, safety and hygiene at work, protective measures with regard to the terms and conditions of employment of pregnant women or women who have recently given birth and of children and young people and equality of treatment between men and women and other provisions on non-discrimination.

(20) Whereas the Member States must be able to ensure that the insurance products and contract documents used, under the right of establishment or the freedom to provide services, to cover risks situated within their territories comply with such specific legal provisions protecting the general good as are applicable; whereas the systems of supervision to be employed must meet the requirements of an integrated market but their employment may not constitute a prior condition for carrying on insurance business; whereas from this standpoint systems for the prior approval of policy conditions do not appear to be justified; whereas it is therefore necessary to provide for other systems better suited to the requirements of an internal market which enable every Member State to guarantee policyholders adequate protection;
