In the European Union the patentability of the human genome has been the subject of heated debate since the mid-1980s. In 1998 the European Parliament and the Council, having noted that there was no Community law specifically to protect the processes and products of the new biotechnology sector, adopted Directive 98/44/EC on the legal protection of biotechnological inventions to define the limits within which ‘biological material’ and hence gene sequences could be patented in an attempt to settle the controversy.
Dans l'Union européenne, la brevetabilité du génome humain a fait l'objet d'un débat controversé dès la moitié des années 80, mais le Parlement européen et le Conseil, constatant qu’il n’existait pas de cadre juridique communautaire qui prévoie spécifiquement la protection des procédés et des produits du nouveau secteur des biotechnologies, ont adopté en 1998 la directive 98/44 sur la protection juridique des inventions biotechnologiques pour préciser les limites autorisées au brevetage du « matériel biologique » et donc aussi des séquences géniques et pour chercher à donner une réponse à ces controverses.
